Employee Injury Insurance:

3. Limitation of Liability
Neftaly commits to limiting potential liabilities while ensuring accountability:
Neither party shall exclude liability for death or personal injury due to negligence or fraud.
Neftaly indemnifies and keeps the City of Ekurhuleni indemnified against any damage to City property or losses resulting from acts or omissions of Neftaly personnel.
Liability for indirect or consequential losses, including loss of profits, goodwill, or anticipated savings, will not apply.
The aggregate liability of Neftaly in relation to this contract shall not exceed the fees paid in the 12 months preceding the claim.
4. Governance and Oversight
Neftaly will appoint a Project OH&S Officer responsible for:
Monitoring OH&S compliance across all project activities.
Ensuring timely reporting and resolution of safety incidents.
Coordinating with the City to validate insurance and risk management measures.
Neftalyโs OH&S and insurance framework guarantees that all field operations, training, mentorship, and business support activities are executed safely, professionally, and in full compliance with statutory requirements, ensuring the protection of personnel, beneficiaries, and the City of Ekurhuleni.
